Four firms have sought Judicial Review over the cancellation of a tender for the supply, delivery, warehousing and distribution of over 259,000 metric tonnes of fertiliser for the 2022/2023 farming season.
The firms are Evergreen fertilizer limited, Stoutone Investments Limited, Samar Agro investments Limited and Conchak Investments limited.
They have sued the Appeals committee of the Zambia Public Procurement Authority -ZPPA- and the Procurement Committee at the Ministry of Agriculture.
They have sought a declaration that the decision to terminate their tender for the supply of fertiliser is illegal and unreasonable.
The firms have also sought an order to move the High Court to quash the decision.
They have also sought an order of prohibition to restrain the ZPPA Procurement Committee and the Ministry of Agriculture from proceeding with allegedly non- competitive open bidding procedure for the supply of fertilizer.
The firm said if their application for judicial review is granted, the same must operate as a stay of the decision to cancel their tender for the supply of Fertiliser.
