The Anti-Corruption Commission -ACC- has arrested former Ministry of Defence Permanent Secretary STARDY MWALE for corrupt practices involving over 573. 9 million dollars in relation to the procurement of the Gulfstream Presidential Jet.
Mr. MWALE 51, has since been charged with three counts of willful failure to comply with Applicable Law and Procedure and one count of fraudulent facilitation of payment from the Public Revenue.
ACC Head Corporate Communication TIMOTHY MOONO says investigations have established that Mr. MWALE whilst acting with others, between January and December, 2017, being Permanent Secretary and the Chairperson of the Ministerial Procurement Committee for the ministry of Defence, did willfully fail to comply with the applicable law and procedure in the manner he approved the award of the tender for the jet.
He says this extends to the manner he signed the amendment of contract relating to the procurement of the Modernisation of the Defence forces Program at a contract price of 400 million dollars without approval from the Ministry Procurement Committee.
Mr. MOONO adds that investigations have also established that Mr. MWALE whilst acting with others, between January, and December, 2019 did willfully failed to comply with the applicable law and procedure in the manner he signed a novation of the contract between Elbit Systems Limited and Ministry of Defence to Savenda Systems Limited at a contract price of over 123-million dollars.
He says that other issues established by investigations by the ACC include fraudulent facilitation of 50-million dollars payment to Elbit Systems Limited for goods and services not supplied in full.
Mr. MOONO says the ACC has also arrested and jointly charged members of the Ministerial Procurement Committee for the Ministry of Defence with Mr. MWALE for Wilful Failure to Comply with Applicable Law and Procedure relating to the approval and awarding of the tender for the procurement of the Modernisation of the Defence forces Program.
Mr. MOONO in a statement to ZNBC says Mr. MWALE and the other three have been released on bond and are expected to appear in court soon.
